Administrative & constitutional — Czechia

vyhláška 177/1996 Sb. § 9 odst. 5, 6 (lawyer fees) + zák. 549/1991 Sb. (správní soudnictví, ústavní stížnost)

Administrative and constitutional cases sit on two different fee tracks but cluster naturally as a pair. Administrative-court actions (správní soudnictví, SŘS) and matters under část pátá OSŘ run under vyhl. 177/1996 Sb. § 9 odst. 5 with a 88 000 Kč substituted tariff value on the lawyer side, and Položka 18 of the Sazebník on the court-fee side — typically a flat 3 000 Kč. Constitutional complaints sit in § 9 odst. 6 with a 128 000 Kč substituted tariff value (general case), but on the state-fee side they are entirely outside zák. 549/1991 Sb. — the Ústavní soud is governed by its own statute, zák. 182/1993 Sb., and řízení before it does not attract court fees. The two case types together cover the public-law side of the calculator.

01 — § 9 odst. 5

Administrative court matters (SŘS) and Part 5 OSŘ (§ 9(5))

Actions before the krajský soud sitting as the správní soud (typical first-instance administrative-court route) and the kasační stížnost to the Nejvyšší správní soud — the žaloba proti rozhodnutí správního orgánu, žaloba o ochraně proti nezákonnému zásahu, žaloba o ochranu před nečinností, all under soudní řád správní (zák. 150/2002 Sb.). The § 9 odst. 5 paragraph also covers the part 5 OSŘ track: civil-court review of administrative decisions in private-law matters (typically social-security and pension-board decisions reviewed by the civil court rather than the administrative court). Both forks substitute the same 88 000 Kč tariff value on the lawyer side.

You file an SŘS action when an administrative authority’s final decision infringes your subjective public rights and the regular administrative remedies are exhausted; part 5 OSŘ catches the narrower private-law-review channel where the legislature has routed certain administrative-decision reviews to civil rather than administrative courts.

Lawyer fee — § 9 odst. 5. Tariff value substituted at 88 000 Kč → per-act sazba 4 620 Kč under § 7 (1 500 + 40 × 78). State court fee — Položka 18 odst. 2 písm. a) sazebníku. Flat 3 000 Kč for the SŘS žaloba. The part 5 OSŘ fork resolves to Položka 18 odst. 1 písm. b), also 3 000 Kč. Sub-bands 18 odst. 2 písm. b) — party-registration challenge at 5 000 Kč — and 18 odst. 2 písm. c) — party reactivation at 15 000 Kč — are not yet captured separately from the generic admin-court filing; the engine defaults to 3 000 Kč for the typical case.

02 — § 9 odst. 6

Constitutional complaint — general (§ 9(6))

The ústavní stížnost — the constitutional remedy in front of the Ústavní soud against an act of public power that infringed a constitutionally guaranteed right. § 9 odst. 6 substitutes a 128 000 Kč tariff value for the general case (i.e. outside guardianship / minor / adoption, which carry the reduced 30 000 Kč substitution under the § 9(6) exception — see the family group). The 128 000 Kč substitution makes the per-act sazba 6 220 Kč — the second-highest in the § 9 catalogue, reflecting the procedural weight of a full constitutional-law analysis and the irreversible nature of the remedy.

You file it under § 72 a násl. zákona č. 182/1993 Sb. when an act of public power — typically a final court decision or a procedural step that cannot be remedied otherwise — has infringed your basic rights or freedoms under the ústavní pořádek, the regular remedies are exhausted, and the 60-day deadline of § 72 odst. 3 is still open. Representation by an advocate is mandatory.

Lawyer fee — § 9 odst. 6. Tariff value substituted at 128 000 Kč → per-act sazba 6 220 Kč under § 7 (1 500 + 40 × 118). State court fee. None. Řízení před Ústavním soudem nepodléhá soudním poplatkům per zákon č. 182/1993 Sb. — the Ústavní soud is outside the scope of zák. 549/1991 Sb. The Sazebník does not contain a Položka for ústavní stížnost; treating it as Položka 19 (kasační stížnost) is a common error — Položka 19 is the cassation to the Nejvyšší správní soud, a different extraordinary remedy in administrative court.
