Enforcement — Denmark

Retsafgiftsloven §§ 12-13 — court fees only; no statutory lawyer tariff in Denmark

Enforcement in Denmark is handled by the bailiff’s court (fogedret), a division of the district court. Two routes matter here: the payment order (betalingspåkravDenmark's payment-order procedure (betalingspåkrav, Retsplejeloven chapter 44 a) — a simplified route to an enforceable title for an undisputed money debt up to 100,000 kr, filed at the bailiff's court (fogedret). Its court fee is a flat 750 kr (Retsafgiftsloven § 12); unlike Estonia or Bulgaria there is no special order-proceedings rate. If the debtor objects, the matter converts to ordinary proceedings.Glossary →) for undisputed debts, and the enforcement (tvangsfuldbyrdelse) of a money judgment to collect on an existing title. Both carry a flat court fee (retsafgiftDenmark's court fee — the mandatory charge payable to the court to bring or proceed with a case, fixed by the Retsafgiftsloven (Court Fees Act). Since the 2021 reform the filing fee is a fixed amount, not a percentage: 750 kr for a claim up to 100,000 kr (or with no economic value) and 1,500 kr above (§ 1), with an optional fixed main-hearing fee (§ 2). It is a court cost, not a lawyer fee — Denmark has no statutory lawyer tariff — and it carries no moms (VAT).Glossary →) under the Retsafgiftsloven — § 12 for the payment order, § 13 for enforcement. Unlike Estonia and Latvia, where bailiff remuneration sits in a separate statute, Denmark’s enforcement court fee is inside the same Act. The fees are mandatory, government-set charges payable to the court; Denmark has no statutory lawyer tariff, so representation is agreed privately.

01 — § 12

Payment order (warning procedure)

The simplified collection procedure (betalingspåkrav, Retsplejeloven chapter 44 a) for an undisputed money debt of up to 100,000 kr. It is filed directly at the bailiff’s court and, if the debtor does not object, becomes an enforceable title without a full trial.

You file it when a debt is clear and not genuinely disputed, and you want an enforceable title quickly and cheaply rather than litigating.

State court fee — § 12. A flat 750 kr. Denmark has no special order-proceedings rate — unlike Estonia’s 3% payment-order fee or Bulgaria’s halved claim, the betalingspåkrav pays the ordinary § 1 grundafgift, which for a procedure capped at 100,000 kr is always 750 kr.

02 — § 13, stk. 1

Enforcement of a money judgment

Enforcement of a money judgment — attachment (udlæg) and forced realisation of the debtor’s assets at the bailiff’s court, on the strength of an existing title.

You file it after you hold an enforceable judgment or title and the debtor still has not paid, so that the bailiff can attach assets to satisfy the debt.

State court fee — § 13 stk. 1. A flat 750 kr for enforcement (udlæg / tvangsfuldbyrdelse / arrest) at the bailiff’s court. This is a computed in-statute fee — not an out-of-scope referral as in Estonia and Latvia. (Enforcement of fines and certain public claims is exempt under § 14.)
