Out-of-court — Croatia

Odvjetnička tarifa NN 138/2023 Tbr. 34–35 (lawyer fees) — no state court fee

Not every legal matter reaches a court. A large share of an advocate’s work in Croatia is out-of-court (izvansudski): oral advice, conferences with the client or the other side, and the review of a problem before anyone decides whether to litigate. The Odvjetnička tarifaCroatia's lawyers' tariff (NN 138/2023) — the Croatian Bar Association (HOK) point-value scale, adopted with the Minister of Justice's consent, that sets reference lawyer fees per procedural action.Glossary → (NN 138/2023) prices this work too — on a time basis rather than a value basis — and because no court is seized, there is no state court fee (sudska pristojbaCroatia's court fee (Uredba o Tarifi sudskih pristojbi, NN 37/2023) — the state charge to bring or pursue a case, banded by claim value with a cap, separate from the lawyer's fee and carrying no PDV.Glossary →) to add. That is the defining feature of this group: the calculator shows only the lawyer fee and hides the court-fee block entirely. Out-of-court work is also where the client and advocate most often agree a fee in writing, with the tariff figure serving as the reference point.

Consultation / conference (per hour)

Oral legal advice or a conference (savjet / konferencija) — the advocate hears the matter, explains the legal position, and recommends the next step, without filing anything in court. This is the typical first contact with a lawyer: a client brings a contract, a dispute, or a letter and asks what their options are.

You instruct counsel for a consultation whenever you need a professional read on a situation before committing to a course of action — and frequently the consultation is what determines whether one of the litigation case types in this calculator ever becomes relevant.

Lawyer fee — Tbr. 34 i Tbr. 35. Charged per started hour: 50 bodThe tariff point of the Croatian Odvjetnička tarifa — one bod = 2,00 € (Tbr. 54). Each procedural action is awarded a number of points, and the fee is the point count multiplied by the bod value.Glossary → (100 € net) for each hour of oral advice or conference. The calculator multiplies the per-hour award by the number of hours and adds 25% PDV. State court fee. None — no court is seized by out-of-court advice, so no sudska pristojba arises. The calculator returns no court fee and hides the state-fee block.

The figure is an indicative reference under the HOK Odvjetnička tarifa (NN 138/2023) — a default and cost-recovery scaleA tariff used to decide how much of the winner's legal costs the losing party must reimburse — distinct from what the lawyer privately charges the client.Glossary →, not a binding minimumA tariff floor a court could once not go below. Several EU jurisdictions abandoned binding minimums after CJEU rulings; where that has happened, the same figures now serve only as reference values.Glossary →; for out-of-court work in particular, lawyer and client commonly agree a fee in writing (čl. 18 Zakona o odvjetništvu).
