Real estate & land registry — Poland

Rozp. MS § 5 (lawyer fees, Dz.U. 2026 poz. 215 / 118) + u.k.s.c. art. 27, art. 38–46 (state court fee, Dz.U. 2025 poz. 1228)

The real-estate group bundles eight case types that share the § 5 lawyer-fee article but diverge widely on procedural shape and state-fee article. Some are value-scaling on the property value (adverse possession, co-ownership termination, land-registry discrepancy), some are flats (boundary, easement, possession disturbance, common-property management, simple land-registry entries). The state-fee side carries a parallel split: art. 27 pkt 7 / 8 for the possessory pozew flats, art. 38 / art. 41 for the value-divorced 1 000 zł / 300 zł co-ownership flats, art. 42–46 for the land-registry tariff, and art. 13 proportional for the rei vindicatio. The umbrella lawyer-tariff article is § 5 of the Minister of Justice ordinance (Dz.U. 2026 poz. 215 / 118).

01 — § 5 pkt 1

Adverse possession

The non-contentious wniosek under KC art. 172 to confirm acquisition of ownership by long-term possession in good or bad faith (20 or 30 years for immovable property). Common scenario: a successor in possession seeks to perfect the title to land that has been used and treated as own for decades, where the formal title chain is broken or missing.

You file it when the possession conditions are satisfied and a formal court order is needed to ground a księga wieczysta entry. The procedure runs before the sąd rejonowy at the location of the property; the wnioskodawca must prove continuous, public, and self-acting possession for the full period.

Lawyer fee — § 5 pkt 1. The § 2 tier table on the value of the right adversely possessed, scaled to 0.5× of the standard scale. State court fee — art. 39 ust. 1 pkt 1 u.k.s.c. A flat 2 000 zł for adverse possession of immovable property (200 zł for other rights — the calculator surfaces the real-estate default). Both sides round up under art. 21 and floor at 30 zł.

02 — § 5 pkt 2

Boundary determination

The non-contentious procedure under KC art. 153 to fix the line between two adjacent properties when the boundaries on the ground, in the cadaster, and in the parties’ titles do not agree. The procedure usually starts before the wójt / burmistrz (administrative phase) and converts into a court matter under KPC art. 606 ff. when the administrative phase fails or one side refuses to accept the proposal.

You file it when neighbours have a real boundary dispute that the cadaster cannot resolve administratively. A surveyor (geodeta uprawniony) is invariably appointed; the work involves on-site measurements, comparison with archival maps, and reconciliation against the chain-of-title.

Lawyer fee — § 5 pkt 2. A flat indicative 720 zł. State court fee — art. 39 ust. 1 pkt 2 u.k.s.c. A flat 200 zł per wniosek (note: actual practice often combines with the geodeta’s costs, which sit outside the court fee).

03 — § 5 pkt 3

Easement (establishment, modification, removal)

The non-contentious procedure under KC art. 285 ff. to set up, modify, or extinguish a służebność — most commonly a służebność drogi koniecznej (right-of-way of necessity, KC art. 145) when a parcel has no usable access to a public road, or a służebność przesyłu (utility easement, KC art. 305¹ ff.) over land crossed by power or pipeline infrastructure.

You file it when the easement is genuinely needed and the parties cannot agree on contractual terms. The decree fixes the easement’s location, width, and conditions of use; for paid easements, also the annual fee or one-time payment.

Lawyer fee — § 5 pkt 3. A flat indicative 480 zł. State court fee — art. 39 ust. 1 pkt 1 u.k.s.c. A flat 200 zł per wniosek for the residential easement-of-necessity track; combined-with-contentious tracks fall back to art. 13 proportional on the easement’s capital value.

04 — § 5 pkt 4

Disturbance of possession

The fast-track possessory pozew under KC art. 344 — actio possessoria, designed to restore the previous state of possession without examining the underlying right of ownership. Standing is broad (any possessor, even a bad-faith one, can sue); time limit is one year from the disturbance.

You file it when someone has interfered with your possession (taken physical control of an item, blocked your access to land, etc.) and you want a quick procedural restoration without litigating ownership. Defences are narrow — the defendant cannot raise their better title in this proceeding.

Lawyer fee — § 5 pkt 4. A flat indicative 320 zł. State court fee — art. 27 pkt 7 u.k.s.c. A flat 200 zł per pozew (naruszenie posiadania).

Land-registry entry / document deposit

The simple registry act — filing a wniosek to enter an ownership change, a mortgage, an easement, or another rzeczowe right in the księga wieczysta. The procedure runs before the wydział wieczystoksięgowy of the sąd rejonowy and is generally summary; the court verifies the formal correctness of the submitted documents without substantive review of the transaction.

You file it after any transaction that produces a registrable change — sale, donation, inheritance, mortgage, easement contract. The notary typically submits the wniosek as part of the transaction closing for sales of immovable property; for inheritance and post-divorce changes, the parties usually file directly.

Lawyer fee — § 5 pkt 5. A flat indicative 480 zł. State court fee — art. 42 ust. 1 u.k.s.c. A flat 200 zł for the standard ownership entry (default). Other subtypes use art. 42 ust. 2 / 3 (proportional or 150 zł for inheritance-based entries), art. 43 (150 zł for the post-divorce and small-agricultural set), art. 44 (100 zł for księga setup, merge, split, corrections), and art. 46 (½ × wpis fee for a deletion).

06 — § 5 pkt 6

Termination of joint ownership

The non-contentious procedure under KC art. 210 ff. and KPC art. 617 ff. to zniesienie współwłasności — dissolving the shared ownership of an asset (most commonly a property) by physical division, by allocation to one co-owner with cash settlement (spłata), or by public sale. The procedure is structurally identical to inheritance division (dział spadku) and runs before the sąd rejonowy at the location of the property.

You file it when co-owners cannot agree on how to use, manage, or dispose of the common asset, or when one co-owner wants out. A zgodny projekt zniesienia attached to the wniosek discounts both the lawyer fee (× 0.5) and the state fee (300 zł instead of 1 000 zł under art. 41).

Lawyer fee — § 5 pkt 6. The full § 2 tier table on the share value, optionally halved by the mutual-application discount. State court fee — art. 41 u.k.s.c. Two-tier conditional flat: 1 000 zł default, 300 zł with a zgodny projekt zniesienia. Same divergence pattern as joint-property division: the lawyer side scales; the state side does not.

Use / management of common property

The non-contentious procedure under KC art. 199–203 to settle disagreements over use (korzystanie z rzeczy wspólnej) or management (zarząd rzeczą wspólną) of a common asset short of dissolving the co-ownership itself. The court can replace the missing consent of an absent or recalcitrant co-owner, appoint a manager (zarządca), or allocate specific parts of the property to specific co-owners for exclusive use (podział quoad usum).

You file it when the co-owners are deadlocked on a specific decision (a major repair, a new lease, an investment) but are not ready to terminate the co-ownership outright. The procedure is a middle ground between informal cooperation and the full zniesienie.

Lawyer fee — § 5 pkt 7. A flat indicative 480 zł. State court fee — art. 39 ust. 1 pkt 1 u.k.s.c. A flat 200 zł per wniosek for the basic management decision.

Discrepancy in land registry

The action under KWH art. 10 to uzgodnienie treści księgi wieczystej z rzeczywistym stanem prawnym — aligning the book entry with the actual legal state when the registered ownership, mortgage, or other right does not match reality (e.g. an heir is not yet entered, a long-extinguished mortgage still sits on the book, a sale has not been transcribed). The action runs as a pozew before the sąd rejonowy at the property location.

You file it whenever a specific entry in the księga wieczysta needs to be changed and the registry court cannot make the change on a simple wniosek — typically because the underlying claim is contested or requires fresh evidence beyond the documentary basis the registry court reviews. The judgment then grounds the registry change.

Lawyer fee — § 5 pkt 8. The § 2 tier table on the value of the disputed right, scaled to 0.5× of the standard scale. State court fee — art. 27 pkt 8 u.k.s.c. A flat 200 zł per pozew (uzgodnienie treści księgi wieczystej).

Polish stawki minimalne are reference valuesA tariff figure that is advisory, not mandatory — a guide to what a fee customarily is, which the lawyer and client remain free to depart from. Every number Tarifo shows is a reference value.Glossary →, not binding floorsA tariff floor a court could once not go below. Several EU jurisdictions abandoned binding minimums after CJEU rulings; where that has happened, the same figures now serve only as reference values.Glossary → for private fee agreements. Following Trybunał Konstytucyjny SK 105/20 (2023) and the 14 May 2024 amendment, the only provision that previously bound private fees (§ 15 ust. 2) has been repealed. The values shown apply to court cost-shifting and ex officio fees, and are net of 23% VAT. State court fees under u.k.s.c. are statutory and exempt from VAT. The real-estate group carries the widest range of state-fee articles in the Polish tariff — flats under art. 27 / art. 39 for the possessory tracks, conditional flats under art. 38 / art. 41 for divisions, the dedicated art. 42–46 tariff for księga wieczysta entries, and art. 13 proportional for the rei vindicatio track when ownership itself is at stake.
