Enforcement — Romania

Ghid UNBR 230/2025 pct. 2.4 (lawyer fees) + OUG 80/2013 art. 10 (state fee)

Once a creditor has a final judgment, a notarial title, or another titlu executoriu, the actual recovery happens through executare silită — the bailiff seizes assets, garnishes accounts, sells immovables. The court’s role narrows to încuviințarea executării (authorising the bailiff to start) and to ruling on objections from the debtor. Ghid UNBR 230/2025 pct. 2.4 sets the indicative lawyer fees for representing either side; OUG 80/2013 art. 10 sets the modest court fees. Note: bailiff fees, expert valuations, and publication costs are not included in either calculation — those are the actual recovery costs and depend on what gets seized and sold.

01 — pct. 2.4.1

Patrimonial enforcement proceedings (executare silită patrimonială)

Enforcement of a title with a monetary content — recovering a debt, executing a contractual sum, enforcing a judgment for damages. The bailiff identifies and seizes assets up to the debt; the court’s input is mostly procedural (authorisation, rulings on objections).

You instruct counsel for executare silită patrimonială when you hold a final and enforceable monetary title and need help navigating which bailiff has territorial competence, which assets to pursue, and how to head off the predictable objections from the debtor.

Lawyer fee — pct. 2.4.1. The same banded scale as the general patrimonial action (pct. 2.2), because the work scales with the amount at stake. State court fee — OUG 80/2013 art. 10 alin. (1) lit. a). A flat 20 RON for the încuviințare. Bailiff fees themselves are governed by separate ministerial regulation and are not part of either calculation.

02 — pct. 2.4.2

Non-patrimonial enforcement proceedings

Enforcement of an obligation to do, refrain from doing, or hand over something — restoring possession, removing an encroachment, complying with a custody arrangement. There is no scale to compute; the work is intrinsic to the type of order and the resistance to compliance.

You file it when the debtor will not voluntarily comply with a non-monetary judgment and the bailiff needs court authorisation to enforce.

Lawyer fee — pct. 2.4.2. A flat indicative 3 200 RON. State court fee — OUG 80/2013 art. 10 alin. (1) lit. a). A flat 20 RON.

03 — pct. 2.4.4

Enforcement contestation — non-patrimonial

The debtor’s procedural remedy against an enforcement act they consider unlawful — wrong bailiff, missing notification, an act outside the scope of the title, premature seizure. The court reviews the contested act, not the underlying merits.

You file it when an enforcement act has gone wrong on the procedural side and the contestation deadlines (typically 15 days from the contested act under CPC art. 715) are still open.

Lawyer fee — pct. 2.4.4. A flat indicative 3 200 RON. State court fee — OUG 80/2013 art. 10 alin. (2) teza II. A flat 100 RON.

04 — pct. 2.4.5

Request to suspend enforcement

An incident in the enforcement file — the debtor asks the court to suspend the bailiff’s activity pending another procedure (e.g. a contestation, an appeal of the underlying judgment). The suspension is provisional and the substantive remedy still has to be litigated on its own track.

You file it when continued enforcement would cause irreparable harm — sale of the family home, dismantling of business inventory — that a later refund cannot fix, and the underlying procedure has a plausible chance of overturning the title or the act.

Lawyer fee — pct. 2.4.5. A flat indicative 1 280 RON — the lowest in this group because the work is narrowly scoped to the suspension hearing. State court fee — OUG 80/2013 art. 10 alin. (1) lit. b). A flat 50 RON.

Bailiff fees, expert valuations, transcript fees, and publication costs are not in either calculator — they sit with the bailiff under separate ministerial regulation and depend on what actually gets seized and sold. The numbers above cover only the lawyer’s representation and the court’s processing of the enforcement-side filings. All lawyer figures are indicative references under Hotărârea UNBR nr. 230/2025.
