Family-law matters in Slovenia run under the Družinski zakonik (DZ) and, since the 2022 renumbering of the Odvetniška tarifa, sit in the non-contentious chapter at Tar. št. 27. The lawyer fee here is a flat točka award per proceeding type rather than a value-banded scale — the work is measured by the kind of family decision sought, not by a sum in dispute. The court fee is a small fixed amount under ZST-1, and several family enforcement actions (child or spousal maintenance) are exempt entirely.
Divorce (razveza zakonske zveze)
Dissolution of a marriage. Slovenia distinguishes a contested divorce (tožba/predlog za razvezo, which proceeds through a hearing) from a joint petition for divorce by mutual consent (sporazumna razveza), which is the simpler and cheaper path when the spouses agree on the consequences.
You file the contested route when the spouses disagree on the divorce or its consequences; the consensual route when they have a complete agreement on property, residence and any children.
Lawyer fee — Tar. št. 27. Contested: a flat 160 točk (96 €) for the petition plus 320 točk (192 €) for the first hearing; the calculator exposes an uncontested toggle that drops the fee to a flat 80 točk (48 €) under Tar. št. 27 toč. 8. State court fee — ZST-1 Tar. št. 1211. A flat 66 €, regardless of value (and, under Art. 20 ZST-1, the single fee covers custody/maintenance litigated in the same proceeding).
Compute this case in the calculatorCustody, access & maintenance (varstvo, stiki in preživljanje)
A standalone proceeding to decide custody and upbringing (varstvo in vzgoja), contact (stiki) and maintenance (preživljanje) — independent of a divorce. Typical scenario: parents who never married, or whose divorce closed earlier and the original arrangements no longer fit the child’s circumstances.
You file it when the practical arrangements need to change and the parents cannot agree, or when a parent seeks an enforceable contact and support order.
Lawyer fee — Tar. št. 27 toč. 1, al. 5. A flat 480 točk (288 €) for the filing plus 320 točk (192 €) for the first hearing. State court fee — ZST-1 Tar. št. 1212. A flat 41 €. (Enforcement of a maintenance claim is itself exempt from court fees under ZST-1.)
Compute this case in the calculatorPaternity / maternity (ugotovitev očetovstva ali materinstva)
Establishing or challenging paternity or maternity (ugotovitev ali izpodbijanje očetovstva oziroma materinstva). The action targets the personal-status record and usually turns on DNA evidence, with narrow standing and time limits under the Družinski zakonik.
You file it when there is a concrete reason to establish or dispute legal parentage and the standing and time conditions are met.
Lawyer fee — Tar. št. 27 toč. 1, al. 3. A flat 320 točk (192 €) for the filing, with the first hearing re-awarded at the same 320-točka rate. State court fee — ZST-1 Tar. št. 1212. A flat 41 €.
