Individual labour disputes in Slovenia are heard by the specialised delovna in socialna sodišča under the Zakon o delovnih in socialnih sodiščih. The Odvetniška tarifa splits them at Tar. št. 16 into non-monetary disputes about the employment relationship itself and monetary claims for pay or benefits, each with its own fee shape. The court-fee side carries a defining feature: an employee bringing an employment-existence dispute is exempt from court fees altogether.
Employment dispute (existence/termination) — non-monetary
A non-monetary dispute about the formation, existence or termination of the employment relationship (sklenitev, obstoj, prenehanje delovnega razmerja) — the classic unfair-dismissal or reinstatement claim. The lawyer fee is a flat točka award rather than a value scale, because the dispute is about status rather than a sum.
You file it when an employee challenges a dismissal or asserts the existence of an employment relationship; the calculator’s employer-side toggle reflects the tariff’s doubling when counsel acts for the employer.
Lawyer fee — Tar. št. 16 toč. 1b. A flat 300 točk (180 €), re-awarded for the first hearing; the employer side is doubled (×2) under Tar. št. 16 toč. 1c. State court fee. The employee is exempt (ZST-1 Tar. št. 2211, opomba a), so the calculator shows no court fee on the employee side; the employer side would pay a flat 41 €.
Compute this case in the calculatorEmployment dispute — monetary claim
A monetary employment claim — unpaid wages, allowances, severance or other benefits expressed as a sum. Because the claim has a determinable value, the lawyer fee uses the same Tar. št. 19 value scale as a civil money claim.
You file it to recover quantified amounts owed under the employment relationship.
Lawyer fee — Tar. št. 16 toč. 1a. The Tar. št. 19 value-banded scale on the claim value, re-awarded per hearing. State court fee — ZST-1 Tar. št. 2111. The Art. 16 base fee × 0,9 — the reduced labour multiplier (e.g. a 5.000 € claim is 85 € × 0,9 = 76,50 €).
