Methodology — Cyprus
This page explains how Tarifo's Cyprus calculator turns a case description into a fee estimate. Cyprus is a state-fee-only jurisdiction: statutory minimum lawyer fees were abolished in 2018, so there is no lawyer tariff to encode — the calculator's single output is the mandatory court fee payable to the court registry, from Table A (ΠΙΝΑΚΑΣ Α) of the Court Fees Procedural Rules (546/1953). Every figure is in euro and traces back to a numbered position (Θέση) in the rule.
One engine: the mandatory court fee.
The Cyprus calculator encodes Ο περί Δικαστικών Τελών Διαδικαστικός Κανονισμός (546/1953), ΠΙΝΑΚΑΣ Α (ΠΙΝΑΚΑΣ Α, Table A), in its current consolidated form through amendment 26/2023 — the Court of Appeal (Εφετείο) reform of 11/2023, in force 3 July 2023. Scope is the courts of the Republic of Cyprus, government-controlled area only.
Unlike every lawyer-tariff country on Tarifo, there is no bar-council tariff to encode — Cyprus abolished statutory minimum lawyer fees in 2018, so advocates’ fees are agreed privately. The calculator’s single output is the court fee a litigant must pay to the registry to file or progress a case. Because these are exact, government-set amounts fixed under Article 163 of the Constitution, the lawyer-tariff “reference valuesA tariff figure that is advisory, not mandatory — a guide to what a fee customarily is, which the lawyer and client remain free to depart from. Every number Tarifo shows is a reference value.Glossary →, not floors / CJEU C-438/22” framing used elsewhere on Tarifo is not applicable here. There is also no legal aid in civil proceedings in Cyprus.
Court fees fall into three shapes.
- Banded fixed — no % , no cap
The headline money-claim fee (
civil_claim_money,civil_small_claims,civil_eviction,labour_wages_claim) under ΠΙΝΑΚΑΣ Α, Θέση 1. Eight fixed bands run €32 / €58 / €90 / €176 / €289 / €480 / €641 up to €2,000,000, then a flat €801 above it. No percentage anywhere and no cap — a €50,000,000 claim pays the same €801 as a €2,000,001 claim.- Distinct enforcement scale
Enforcement of a money judgment (
execution_patrimonial) uses its own table under ΠΙΝΑΚΑΣ Α, Θέση 13 — €6 / €13 / €26 / €39 / €96 / €193 / €257 / €321, topping out at a flat €384 — with extra low sub-bands at €100 / €500 that Θέση 1 lacks. It must never be computed from the Θέση 1 numbers.- Flat statutory fees
Most non-money cases. Matrimonial application €113 (Θέση 2(β)), maintenance €17 (Θέση 5), any originating application with no special fee — paternity, adoption, protection order — €39 (Θέση 4(γ)), warrant for delivery of possession €23 (Θέση 15(i)), prerogative-writ judicial review €350 (Θέση 4(β)).
Appeal is a REPLACEMENT banded scale, not a multiplier. An appeal to the Court of Appeal applies the ΠΙΝΑΚΑΣ Α, Θέση 11 scale (€64 / €96 / €193 / €289 / €480 / €641 / €801) plus a flat €32 record-preparation advance in every case — it does not halve the first-instance fee the way Bulgaria and Romania do. An interlocutory appeal takes half of the Θέση 11 scale, with the €32 advance applied in full.
Court fees are outside the scope of VAT.
Court fees in Cyprus are not subject to VAT. The calculator shows them at face value with no VAT line and no VAT toggle. Because there is no lawyer tariff, there is no lawyer-fee VAT setting either — Cyprus does apply VAT to advocates’ fees, but advocate fees are not modelled here. Figures are shown natively in EUR; Cyprus is in the eurozone, so the cross-country Comparisons section needs no conversion.
A money claim, first instance.
Take a money claim with a claim value of €50,000 (civil_claim_money, first instance):
| Step | Source | Result |
|---|---|---|
| Claim value | input | €50,000.00 |
| Band «€10.000 < V ≤ €50.000» (Θέση 1(δ)) | fixed amount for this band | €176.00 |
| Court fee, first instance | no percentage, no cap, no VAT | €176.00 |
The same case at exactly €10,000 yields €90 — the band below — because the bands use «υπερβαίνει … όχι όμως» (inclusive upper bound), so the €10,000 boundary belongs to the lower band and the next band engages only strictly above it (€10,000.01 → €176). At €50,000.01 the fee steps to €289, and any claim above €2,000,000 is the flat €801. The same €50,000 claim on appeal is €193 + €32 = €225 (Θέση 11), not half of €176. These boundaries are pinned in the engine’s unit tests.
Four places the numbers surprise you.
civil_claim_moneyA €50,000,000 claim pays the flat €801 top band. There is no percentage rate and no cap arithmetic — unlike England & Wales (5 % band + £10,000 cap) or Romania (percentage-within-band). The top band of the Θέση 1 scale simply is a flat amount.
execution_patrimonialEnforcement uses ΠΙΝΑΚΑΣ Α, Θέση 13, not the Θέση 1 claim scale. A €300 enforcement is €13 (not the €32 Θέση 1 floor); a €5,000,000 enforcement is €384 (not €801). The extra low sub-bands and the lower €384 top band make it a genuinely separate table.
appealBulgaria and Romania halve the first-instance fee on appeal. Cyprus discards the first-instance figure entirely and replaces it with the Θέση 11 scale plus a flat €32 advance. The engine therefore never applies a 0.5 appeal multiplier — the single most likely cross-country copy-paste bug, named as a regression test.
family_child_arrangements / family_adoptionCyprus charges family filings: divorce €113 (Θέση 2(β)), maintenance €17 (Θέση 5), adoption / paternity / protection orders €39 (Θέση 4(γ)). Romania treats the equivalent cases as fee-free (scutit); that exemption was deliberately not carried across.
Two categorical points round out §05. The administrative group holds two distinct cases: admin_judicial_review is the €350 prerogative writ (Θέση 4(β)), while admin_recourse is the far more common Article 146 recourse before the Administrative Court, whose fee is set by Reg. 6/2015 and is pending extraction — the engine returns no number for it, and the €350 must never be reused. Separately, labour claims before the Industrial Disputes Tribunal (Ν. 24/1967) carry no tribunal filing fee in v1 (shown as €0), and probate_grant / insolvency_petition are out of scope — governed by Cap. 189 and Cap. 113 / Cap. 5, with the calculator pointing to the governing framework rather than returning a figure.
